Eddy County Sheriff's report for November

Thomas J. Moore of Corsicana, Texas, was arrested on Oct. 20 and charged with possession of marijuana, possession of hashish and possession of drug paraphernalia, all Class A misdemeanors. Moore was initially stopped for speeding when a subsequent search of the vehicle by Eddy County deputies revealed the substances, according to the Eddy County Sheriff’s Office. Moore waived his initial appearance and pleaded not guilty to two of the charges. He is due in court on Jan. 10, 2019.

Amy Bertsch of Devils Lake was stopped for speeding on Oct. 10 and was charged with possession of marijuana, possession of methamphetamine, and two counts of possession of drug paraphernalia, one for each marijuana and methamphetamine. All are misdemeanor charges. Bertsch pleaded guilty to all the charges in court on Nov. 15. Judge James Hovey sentenced Bertsch to 30 days in jail with all suspended for 360 days probation. She was also ordered to complete a chemical dependency evaluation including recommended treatment and pay $1,025 in fines and fees.

Darren L. Duda of New Rockford faces a disorderly conduct charge after an altercation with two people on Oct. 17. According to the criminal complaint, authorities allege that he yelled, pushed and shoved two women at one of their homes on First Avenue South in New Rockford. He is due in court for an initial appearance on Dec. 13.

Latasha D. Scott of New Rockford faces a misdemeanor theft charge after she allegedly stole over $200 cash from a cash register at Casey’s General Store where she worked. She will make her initial appearance on Dec. 13.

Michael G. Berry of Towner appeared in court on Nov. 15 for a misdemeanor charge of possession of drug paraphernalia. Berry pleaded guilty to the charge, which was entered on Nov. 9. As it was his first offense, Judge Hovey deferred imposition of sentence and instead ordered him to complete 360 days of unsupervised probation and pay $500 in court fees. The charge will be expunged from his public record next November if he complies with the terms.

Cory G. Greene of Sheyenne was arrested Sept. 10 for driving while under the influence and/or refusal of a chemical test as well as driving under revocation. After he was released on a PR bond, Greene initially pleaded not guilty to the charges. He then amended his plea to guilty in court on Nov. 15. Judge Hovey sentenced Greene to 30 days in jail, with 20 days suspended for 360 days of unsupervised probation and credit for 4 days served. He reported to the Lake Region Correctional Center on Nov. 23 to serve the remaining 6 days. He was also ordered to pay $1,785 in fines and fees, of which $500 was suspended.

Sterling Mayer of New Rockford was sentenced Nov. 15 for driving with a suspended license. The incident occurred Oct.10, during which he was also cited for failure to wear a seatbelt, open container and driving without insurance. Mayer was ordered to serve 360 days of unsupervised probation and pay $770 in combined fines and fees.

Andrew L. Whiteman of New Rockford pleaded guilty to four misdemeanor charges, including two counts of possession of drug paraphernalia, driving under suspension and possession of marijuana in court on Nov. 15. The charges stemmed from an Aug. 24 traffic stop. Whiteman failed to appear in court on Sept. 14, and a warrant was issued for his arrest. He was arrested on Oct. 22 and remained in jail until his appearance on Nov. 15, when he was sentenced to 26 days in jail with credit for 26 days served. He was also ordered to serve 360 days of unsupervised probation, pay $825 in fines and fees, undergo a chemical dependency evaluation and complete recommended treatment.

Jobeth M. Eagle of Bismarck was cited on Aug. 23 for driving under suspension. She failed to appear in court on Oct. 11, so a bench warrant was issued. She was arrested Oct. 23, and Kendrick Eagle posted her bond on Oct. 25. She pleaded guilty to the charge in court on Nov. 15, and she was sentenced to 360 days of unsupervised probation and ordered to pay $750 in fines and fees.

Anthony E. Brown of Sheyenne also appeared in court on Nov. 15 on a driving under suspension charge. He was cited on Oct. 24 after he was stopped for speeding at 21-25 mph higher than the posted limit. Brown pleaded guilty to the charge, was sentenced to 360 days of unsupervised probation and was ordered to pay $440 in fines and fees.

Ross M. Argent of Steele was sentenced on Nov. 15 for possession of marijuana and possession of drug paraphernalia, both Class B Misdemeanors. Argent was stopped for speeding on Oct. 28, when officers discovered the drugs and paraphernalia in his possession. Argent pleaded guilty to the charges and was sentenced to 360 days of unsupervised probation and ordered to pay $500 in fines and fees.

Marissa G. Baer of Sheyenne was arrested on Oct. 30 in Eddy County for driving under the influence and driving under suspension. Baer was operating a motor vehicle traveling at approximately 5 miles an hour when her vehicle crossed the roadway into the oncoming lane and then into the opposite ditch. Baer was being followed by an Eddy County Deputy, and the incident was recorded on the squad car camera system. Baer pleaded guilty to three charges in court on Nov. 15, including driving under the influence, driving under suspension and criminal mischief for damaging a squad car. A fourth charge, refusal to submit to a chemical test, was dismissed. Baer was sentenced to 30 days in jail, with 20 days suspended and credit for 1 day served. She was to report to the Lake Region Law Enforcement Center on Nov. 30 and serve her 9 days. She will also be subject to 360 days of unsupervised probation and ordered to pay $1,750 in fines and fees.

Frank L. Bachmeier of New Rockford was sentenced for theft of property on Nov. 15 after he reached a plea agreement. Bachmeier stole core batteries and vehicle rims from businesses in New Rockford and sold said items for at least $500 in April. He initially pleaded not guilty to the Class A Misdemeanor charge in court on Sept. 13. He was sentenced to 30 days in jail, all suspended for 360 days of unsupervised probation and was also ordered to pay $835 in fines and fees.

Kooper B. Longie of St. Michael was arrested on Aug. 22 and charged with driving under suspension and possession of marijuana. He was initially stopped for failure to display current registration tabs. He pleaded not guilty to the charges on Sept. 13, then amended his plea to guilty on Nov. 15. As a result, he will undergo 360 days of unsupervised probation and pay $800 in fines and fees as part of a deferred sentencing agreement.

Marcella L. Desjarlais of Sheyenne was sentenced for driving under suspension after she also amended her plea in court on Nov. 15. Desjarlais received 360 days of unsupervised probation and was ordered to pay $800 in fines and fees.

Austin D. Perleberg-Hunt of Jamestown appeared in court on Nov. 15 and pleaded guilty to theft from a motor vehicle/firearm. He stole a rifle out of a vehicle in New Rockford on July 22; the gun was recovered but was damaged. He was sentenced to a year and a day in jail, was given credit for time served 45 days and the remaining 321 days were suspended. He was ordered to pay $525 in fines and fees, $400 restitution and serve two years supervised probation.

Warrants have been issued for the following individuals who failed to appear in court: Douglas Geller, Monica R. Gonzalez, Demetre L. Harrison, William A. Malinowski, Preston D. Neumiller and Holly L. Smith.
